results_ecocat (type: esriFieldTypeString, alias: After submitting an EcoCAT to satisfy consultation under Title 17 Ill. Admin. Code Part 1075, you will receive a natural resource review report that either:
A. Closes consultation if no protected natural resources are in the vicinity; or
B. Lists resources that may be in the vicinity and identifies the staff member who will review the action. After review, staff will either:
• Issue a letter stating consultation is closed because adverse effects are unlikely; or
• recommend methods to avoid or minimize potential adverse effects in a final letter. Note, staff may request additional information about a project or field surveys to complete the review
If recommendations are made to avoid or minimize adverse effects, staff will request a response from the Agency or Project Proponent on whether the recommendations will be adopted, in part or entirely, in the project plans.
If staff determine "take" of a state listed species is likely to occur, staff will recommend the Agency or Project Proponent apply for an Incidental Take Authorization (ITA) pursuant to Title 17 Ill. Admin. Code Part 1080 .
Recommended avoidance or minimization measures or application for an ITA may be made conditions of a projects funding, authorization, or performance by the local, state, or federal agency with jurisdiction to ensure compliance with applicable statutes.
In an EcoCAT generated report, a species may appear on the resource list more than once when it occurs in several locations within the project's vicinity. Also, many Illinois Natural Area Inventory (INAI) sites are also Nature Preserves, Land and Water Reserves, or Natural Heritage Landmarks. The sites may overlap, but the legal protections of each designation differ. Apart from Natural Areas, the boundaries of the other designations are based on property ownership and may extend beyond the location of the natural resources.
Failure to consult or adopt Department recommendations may result in:
• Destruction of irreplaceable natural resources
• Negative public relations and potential civil litigation
