                <stepRat>The Land Use Planning Commission has responsibility under the Natural Resources Protection Act to protect certain natural resources, including streams.  One way that the Commission accomplishes that mandate is to regulate uses near streams differently than those in an upland setting.  The area around rivers and large streams are zoned P-SL1.  Within 75’ of small streams, the P-SL2 zone applies, which allows for some activities, but restricts others that might damage the stream.  Because small streams can be hard to map without on-the-ground investigation, the Commission does the best it can to identify the location of streams from available digital information, but also requires that persons conducting certain activities such as building a structure or doing substantial filling and grading to check for streams before beginning the work. 

The Commission, over time, has had to adjust the number and location of streams that are mapped on the Land Use Guidance Maps (zoning maps) as the data and mapping technology have improved.  However, this does not affect the fact that streams receive protection in rule, regardless of whether they are shown on the map.  The maps are meant to let the public know about as many of the streams as the Commission can identify from available data, while recognizing that we do miss some and also identify some that might not meet the definition of a stream.  

Currently, the Commission is improving its mapping technology, to produce maps that are more readable and helpful to the public.  It is an exciting project which staff are eager to share with the Commission.  In the course of working on the final stages of this project, it has become clear that the change in technology will affect how and where streams are displayed on the maps.  

Originally, the P-SL2 zone was depicted as a single line stream channel on the original zoning map;  the 75’ buffer on either side of the stream was not shown.  The new color zoning maps will display the entire zone, including both the single line stream channel and 75’ buffer. 

Another difference between the current and proposed maps is that a number of P-SL2 streams shown on the current maps will not be displayed on the new maps.  The difference can be traced back to the origin of the present maps that were developed in the mid 1990’s.  Prior to the 1990’s the Commission primarily relied on USGS 15’ base contour maps to identify streams and, thus, P-SL2 zones.  In the 1990’s, 7.5’ base contour maps were available and the Commission switched to using these newer USGS maps.  The newer USGS base maps showed fewer streams.  At that time, the Commission manually added streams where they had been shown on the older zoning maps and the contours on the newer 7.5’ maps appeared to support adding a stream back onto the map.  As was the case then, and as remains the case today, conditions in the field control.  This means if a P-SL2 stream is shown on the map but does not exist in the field, or vice-versa, the zoning that is applied is based on what exists on the ground.

As part of shifting to digitally based zoning maps, the zoning map base layer would change again and reflect the USGS’s most recent data.                 <stepRat>The Land Use Planning Commission has responsibility under the Natural Resources Protection Act to protect certain natural resources, including streams.  One way that the Commission accomplishes that mandate is to regulate uses near streams differently than those in an upland setting.  The area around rivers and large streams are zoned P-SL1.  Within 75’ of small streams, the P-SL2 zone applies, which allows for some activities, but restricts others that might damage the stream.  Because small streams can be hard to map without on-the-ground investigation, the Commission does the best it can to identify the location of streams from available digital information, but also requires that persons conducting certain activities such as building a structure or doing substantial filling and grading to check for streams before beginning the work. 

The Commission, over time, has had to adjust the number and location of streams that are mapped on the Land Use Guidance Maps (zoning maps) as the data and mapping technology have improved.  However, this does not affect the fact that streams receive protection in rule, regardless of whether they are shown on the map.  The maps are meant to let the public know about as many of the streams as the Commission can identify from available data, while recognizing that we do miss some and also identify some that might not meet the definition of a stream.  

Currently, the Commission is improving its mapping technology, to produce maps that are more readable and helpful to the public.  It is an exciting project which staff are eager to share with the Commission.  In the course of working on the final stages of this project, it has become clear that the change in technology will affect how and where streams are displayed on the maps.  

Originally, the P-SL2 zone was depicted as a single line stream channel on the original zoning map;  the 75’ buffer on either side of the stream was not shown.  The new color zoning maps will display the entire zone, including both the single line stream channel and 75’ buffer. 

Another difference between the current and proposed maps is that a number of P-SL2 streams shown on the current maps will not be displayed on the new maps.  The difference can be traced back to the origin of the present maps that were developed in the mid 1990’s.  Prior to the 1990’s the Commission primarily relied on USGS 15’ base contour maps to identify streams and, thus, P-SL2 zones.  In the 1990’s, 7.5’ base contour maps were available and the Commission switched to using these newer USGS maps.  The newer USGS base maps showed fewer streams.  At that time, the Commission manually added streams where they had been shown on the older zoning maps and the contours on the newer 7.5’ maps appeared to support adding a stream back onto the map.  As was the case then, and as remains the case today, conditions in the field control.  This means if a P-SL2 stream is shown on the map but does not exist in the field, or vice-versa, the zoning that is applied is based on what exists on the ground.

As part of shifting to digitally based zoning maps, the zoning map base layer would change again and reflect the USGS’s most recent data. In the middle of this process, the NWI maps became available in digital form, which enabled us to utilize the computer to interpret the NWI maps and apply the appropriate wetland zones.  The maps for the Rangeley, Millinocket, and Ashland Regions were drafted in this fashion. 

To take advantage of the efficiencies offered by printing from a digital or electronic source (rather than from a hard copy), we need to take advantage of the digital wetland information for the Somerset, Piscataquis, and Downeast Regions. Unfortunately, this digital information differs slightly from our adopted wetland zones due to the inevitable errors of visually interpreting the NWI maps and hand-drafting the appropriate wetland zones onto the Commission’s zoning map.  

To take advantage of the NWI digital information, we effectively needed to “correct” our wetland zoning for the Somerset, Piscataquis, and Downeast Region maps.
